Privacy Policy

Korax makes all reasonable efforts to safeguard customer information, and does not disseminate customer information without consent to any third party under any circumstances. Korax does not sell or distribute customer or user E-mail address lists to marketers, spammers, or any other individual or organization. All personal information identifying an individual can be completely removed on request when the customer closes an account or when a user stops utilizing a free service. This policy describes how Korax uses the information it collects.

Customer information collected

Korax collects contact information from all web hosting customers for the purpose of identity verification and billing. Information collected at time of signup that identifies an individual includes contact person name and e-mail address. If the account is opened on behalf of an individual and not a company, personally identifying information also includes street address and phone number. This information is stored securely and separately from all other information, and is viewable and editable by the customer through a secure web form that is protected by a unique user name login and password combination that the customer must have in order to gain access to the information. This information is strictly for Korax' internal use to maintain customer services, and is never viewable or useable by any outside party.

The customer can add additional contact persons once an account is opened for the purpose of assigning loosely defined roles within an organization, such as "Billing contact" and "Technical contact". The only information required by Korax when a customer adds a new contact person that may identify that person as an individual is the person's name and a working e-mail address; however, the customer can optionally add up to three separate phone numbers and a fax number. Contact persons can be completely removed from the system by the customer at any time. For purposes of identifying who has legal ownership of an account at Korax, at least one contact person with all roles defined and a working e-mail address must exist for an account.

If a customer enters a credit card when signing up, the credit card will be stored securely so that future charges can be applied should the customer order additional services. The customer always has access to credit card information via the same login method described above, and can view, edit, and permanently delete any credit card number stored on the system. Credit card numbers are never displayed as plain text within a web browser, but are always masked and unreadable, with at least the last four digits and the expiry date viewable so that the customer knows which card is stored. Only highly trusted, authorized personnel at Korax have access to customer credit card numbers, and must themselves use a unique user name login and password combination on a secure server in order to gain access to credit card numbers, and then only in response to a customer's request to edit, delete, add, or make charges to a credit card. When being viewed by Korax personnel, credit card numbers are never shown as plainly visible numbers, but are masked using the same device described above.

Website cookies

Some features and functions of this website, including AMS, use cookies. A cookie is a small amount of data sent by the website to the user's browser. The information includes website preferences, and never contains personally identifiable information such as user names or E-mail addresses, or secure information such as passwords. If users prefer not to have the website store information, cookies can be disabled in the user's browser. The browser's online help, or the browser's vendor, must be consulted in order to turn cookies off. Turning off cookies will disable portions of the website, including AMS.

The following Terms of Service represent the terms under which Korax Inc. agrees to sell its services to you, the customer.
  1. Service and upkeep
    1. Korax is an information provider connected to the Internet, offering storage, file transfer services, and web hosting through access to its servers.
    2. The Customer is responsible for acquiring and maintaining all equipment and software necessary to connect to and make use of Korax's services. Korax specifically disclaims any liability or responsibility for the software used by the Customer in connecting to and making use of Korax's services.
    3. The Customer is responsible for maintaining current and complete backups of all Customer-owned files, data, and other information stored on Korax's servers. Korax will not be responsible for the loss of any Customer-owned files, data, or other information for any reason whatsoever.
    4. Parts of the Internet may periodically experience downtime. Korax cannot guarantee connectivity to networks outside of its control at any given time.
    5. Korax will make every effort to ensure that its service is available at all times.
    6. Use of services advertised as "unlimited":
      1. Korax may at any time offer services advertised as "unlimited".
      2. The term "unlimited" does not constitute uninterrupted, twenty-four hour access to any service.
      3. The term "unlimited" implies no tracking of usage for billing purposes.
      4. Korax reserves the right to monitor usage patterns.
      5. Korax reserves the right to impose reasonable limits on customers' use of its services, notwithstanding the offer of "unlimited" services.
      6. This includes, but is not limited to, the imposition of extra fees for heavy use of any service advertised as "unlimited".
      7. Korax shall be the sole arbiter as to what constitutes "heavy use".
    7. The Customer agrees that any Internet Protocol (IP) addresses assigned to the Customer are the property of Korax, and are assigned to the Customer's use on a strictly temporary and as-needed basis. The Customer further agrees that any such addresses may be changed or withdrawn by Korax at any time and without prior notice, for reasons of administrative or technical nature, or for any other reason as deemed appropriate by Korax.
    8. Domain registration services and SSL certificate orders are processed through Tucows Inc. and are subject to the following Terms and Conditions:
      1. Domain registration services and Whois privacy services are provided in accordance with Exhibit "A", Registration Agreement.
      2. Domain registration services in the .COM, .NET and .ORG top-level domains are subject to the ICANN Uniform Domain Name Dispute Resolution Policy (UDRP).
      3. QuickSSL certificates are provided in accordance with the QuickSSL Subscriber Agreement.
      4. QuickSSL Premium certificates are provided in accordance with the QuickSSL Premium Subscriber Agreement.
      5. True BusinessID certificates and True Site seals are provided in accordance with the True BusinessID and True Site Subscriber Agreement.
    9. It is the Customer's sole responsibility to keep Customer's domain registration data correct, complete and up to date, and to promptly notify Korax of any changes to such information. All communication with Customer regarding domain registration matters, including but not limited to registration renewal reminder notices, shall take place via E-mail to the Customer's Administrative Contact E-mail address as listed in Customer's domain registration at the time such notice is sent. Under no circumstances shall Korax be responsible for damages arising from de-activation, expiration, deletion or other loss of any domain name as a result of invalid or outdated Customer contact information.
    10. The Customer is solely responsible for renewing Customer's domain name registration(s) before the expiration date listed in the domain name registration records, regardless of whether the Customer has received any notice of expiration or renewal reminder from Korax. Under no circumstances shall Korax be responsible for damages arising from de-activation, expiration, deletion or other loss of any domain name as a result of Customer's failure to renew the domain registration before the expiration date.
    11. The Customer agrees to grant Korax permission and access to modify the details of the Customer's domain registration on the Customer's behalf, as deemed necessary for the proper maintenance and operation of the Customer's domain name. Korax expressly denies any claim of ownership to the Customer's domain name which may be implied from this access.
  2. Acceptable usage
    1. The Customer agrees to be responsible for all use of and charges resulting from the use of Korax's services, including, without limitation, use by minors living with the Customer or under the Customer's responsibility, care or direction, and unauthorized use prior to the Customer notifying Korax of such unauthorized use and taking steps to prevent its further occurrence. The Customer agrees that Korax has no responsibility to censor or otherwise regulate information, files, content, data, or other materials to or from minors living with the Customer or under the Customer's responsibility, care, or direction.
    2. The Customer agrees to promptly notify Korax of any unauthorized use of the Customer's Korax account, and to take such steps as are reasonably required to prevent its further occurrence. Should the Customer fail to take appropriate steps to safeguard the reasonable security of the account, Korax reserves the right to suspend the account immediately and without notice.
    3. Customers may only use Korax's services for lawful purposes. Transmission, publication, or storage of any material in violation of federal, provincial, or local laws is prohibited.
    4. Transmission, publication, or storage of copyrighted or trademarked material, or material otherwise infringing on the intellectual property rights of a third party, obscene, threatening, racist, or pornographic material, or material protected by trade secrets, is prohibited. This includes links to any such material.
    5. The Customer agrees not to use Korax's services to copy, communicate, publish, distribute, disseminate, circulate, or sell, or possess or receive for the purpose of the aforementioned, any data, information, content, or any other material which is obscene, libelous, threatening, or harassing, or which advocates or promotes genocide, or incites hatred against or fear of any identifiable group, whether such groups or their activities are socially redeemable or not. Korax shall be the sole and final arbiter of what constitutes a violation of these terms.
    6. This clause and this section also applies to links or any other connection to such material.

  3. Liability
    1. Use of Korax's service is solely at the Customer's own risk.
    2. Korax provides Internet services as a common carrier. Korax makes no effort to monitor the content of the information passing through its systems.
    3. Use of any information obtained via Korax's services is done at the Customer's own risk. Korax specifically denies any responsibility for the accuracy or quality of information obtained through its services, and does not warrant that its services will meet the Customer's requirements.
    4. Korax is not responsible for any demands, liabilities, losses, costs, and claims, including lawyers' fees, asserted against it or its Customers as a result of any service or product published or sold through its service, and the Customer agrees to defend, indemnify, and hold Korax harmless from any and all such claims.
    5. Claims for which Korax is not responsible include, but are not limited to, injury to persons or property arising out of services or products published or sold through Korax's service; material published by the Customer infringing on the rights of a third party; copyright or trademark infringement claims; and claims based on the publication of illegal materials.
    6. The Customer agrees that Korax cannot be held responsible for any damages resulting from loss of data, non delivery or interruption of service, or use of any information passing through Korax's network.
    7. While every reasonable effort is made to ensure privacy of customers' material, Korax cannot guarantee privacy of the Customer's files and/or electronic mail or messages.
    8. All software available on Korax servers is offered as-is, without any guarantee. It is entirely the Customer's responsibility to know how to use the software and to keep up to date with changes in its functionality, and Korax has no responsibility to educate the Customer in this regard.
    9. Korax specifically disclaims any liability or responsibility toward any third party, including any party to whom the Customer may be reselling or otherwise providing services.
  4. Etiquette and acceptable conduct
    1. Use of electronic forums, such as mailing lists, message boards, and Usenet newsgroups, will be conducted by the Customer in a way that conforms to reasonable standards of etiquette and consideration of others. The Customer agrees to abide by all rules and regulations imposed by such forums, and to follow a generally-accepted code of conduct when posting to such forums.
    2. The Customer will not use Korax's services for the purposes of sending unsolicited E-mail (known as "spamming"). Furthermore, the Customer will not send unsolicited E-mail, via facilities provided by Korax or via any other means, for the purpose of advertising, promoting, or otherwise directing traffic to any website, or in connection with any Internet domain name. Failure to comply with this article will result in immediate termination of the account without refund, and the Customer will be required to pay a mandatory UCE Clean-up fee of $200.00 CAD for each incident.
    3. Korax's services may not be used to impersonate another person or entity or misrepresent authorization to act on behalf of another person or entity. This includes forging or masking of E-mail addresses, "spoofing" of host names or Internet addresses, or otherwise falsifying one's identity in any way and for any purpose whatsoever, except where altering such information is expressly permitted. All E-mail sent from Customer's account must have a valid and correct return address.
    4. The Customer may not use Korax's services to attempt to undermine the security or integrity of computing systems or networks, or to attempt to gain unauthorized access to such systems.
    5. Any access to any other communications network(s) through Korax's services must comply with the rules applicable to that/those other communications network(s).
    6. The Customer shall make use of Korax's servers strictly for their intended purpose. Specifically, Korax's web servers may be used only for tasks directly related to the maintenance of Customer website(s) hosted at Korax, and any other use of such servers will be deemed inappropriate use. Korax shall determine what constitutes inappropriate use of its servers and reserves the right to impose restrictions or suspend accounts found to be in violation of these terms.
    7. The Customer agrees not to use Korax's services in a manner that adversely affects the availability of its resources to other customers, or the availability of Internet resources to other Internet users at large. This includes use of web hosting resources such as CGI programming environments, scripts, bandwidth, memory usage, CPU usage, and any other resource offered by Korax to its customers. The installation and running of "server" processes at any time, and the running of background processes when the customer is not actively logged in to the system, is specifically forbidden. The Customer further agrees that Korax, at its sole discretion, may at any time limit use of resources to the Customer, or suspend or terminate the Customer's account without notice if such action is considered warranted by Korax.
    8. The Customer agrees not to use Korax's servers for permanent storage of the Customer's electronic mail (E-mail). The Customer agrees to retrieve and promptly remove all new mail from the server regularly, so as to keep the Customer's E-mail account(s) empty at all times. Korax reserves the right to impose a maximum e-mail account (mailbox) size and to refuse further acceptance of new mail if this limit is exceeded. Korax further reserves the right to deactivate and remove any E-mail account which is not being attended to as per these terms.
    9. The Customer may not use the personal information of other customers that may at any time be available on Korax's public servers for the purpose of harassing other Korax customers by any means whatsoever. The Customer further agrees that Korax cannot be held responsible should such harrassment occur, and to take such steps as are necessary to restrict the availability of any such information from other Internet users, if so deemed necessary. The Customer agrees to become acquainted with the proper steps necessary to restrict such information, and that Korax has no responsibility to educate the Customer in this regard.
    10. Korax reserves the right to modify, suspend, and restrict the use of account features at any time, either during the normal course of system management, or if it has reason to believe that such features are being abused or used for malicious purposes. Furthermore, Korax reserves the right to suspend and/or terminate service without warning and without refund in the event of serious and/or repeated violation of these terms.
    11. Korax shall be the sole and final arbiter of what constitutes a violation of these terms.
  5. Billing
    1. The Customer is required to maintain complete, correct and up to date contact information with Korax at all times. It is the Customer's sole responsibility to maintain this contact information, and to promptly notify Korax of any changes to such information. All communication with Customer regarding Customer's account, including but not limited to renewal reminder notices, billing issues, technical issues and abuse issues shall take place via E-mail to the Customer's contact E-mail address as listed in Korax's records at the time such notice is sent. Under no circumstances shall Korax be responsible for damages arising from de-activation of Customer's services or deletion of Customer's files as a result of invalid or outdated Customer contact information.
    2. All accounts and services offered by Korax either advertised or non-advertised are prepaid. No service shall be delivered to any customer at any time without prior payment for that service. Payment must be received in full one business day prior to the start of any new billing period.
    3. Post-dated cheque payments are not accepted. Post-dated cheques will not be processed, and will incur a service charge of $25.00.
    4. On the purchase of any service by credit card, the Customer agrees that Korax may submit charges to the credit card issuer or its agent for service fees on, prior to, or after the first day of each billing period, regardless of the cycle of that period, without further authorization from the Customer, until the Customer provides a prior request in writing to change the designated credit card. In the event of a notice of change of credit card, such notice will not affect charges submitted by Korax before it could reasonably act on the Customer's request. If payment is not received by Korax from the card issuer or its agents, the Customer agrees to pay all amounts owing on demand. The Customer agrees that Korax may, at its option, accumulate charges incurred during the billing cycle and submit them as one or more aggregate charges during or at the end of each cycle, and that Korax may delay obtaining authorization from the card issuer until submission of the accumulated charges. Korax reserves the right to suspend or terminate the Customer's service without notice upon rejection of any fee charges presented to the card issuer. The Customer must promptly notify Korax of changes to: a) the account number and/or expiration date of the designated credit card; and b) the Customer's billing address. The Customer must also promptly notify Korax if the card is cancelled for any reason.
    5. The default billing period for any and all services offered by Korax is quarterly unless explicitly stated otherwise.
    6. All billing periods and calculations are based on calendar months.
    7. All invoices, bills, sales receipts, or otherwise, shall be generated electronically and delivered via electronic means to the Customer via the Korax website, or as otherwise decided upon by Korax. The Customer agrees that all such electronically published material shall constitute the Customer's binding record of payment received by or payment owing to Korax.
    8. The Customer acknowledges sole responsibility for monitoring the balance and activity of the billing account. Korax will provide the Customer with the means to perform such monitoring either through its website or by other means. An account shall expire and all services become unusable when the Customer has not made sufficient prepayment toward the account, either through neglect, the non-acceptance of the Customer's credit card charge by the credit card issuer, or for any other reason. The Customer agrees that Korax shall not in any way be responsible for any damages resulting from any suspension of service to the Customer.
    9. For Canadian customers, six percent GST will be added to the Customer's amount due.
    10. Any cheque returned to Korax by the Bank for non-sufficient funds will incur a service charge of $25.00, and Korax reserves the right to require some or all subsequent payments to be made by certified cheque or credit card.
    11. Domain registration and renewal fees, SSL certificate purchase and renewal fees, and setup fees are not refundable under any circumstances.
    12. Any account paid by credit card shall be renewed automatically at least seven days before the end of each billing period unless otherwise requested by the Customer. The request must be received at least fifteen days before the end of the current billing period.
    13. Accounts shall continue to incur normal charges while suspended due to non-payment, abuse, or any other reason, and the Customer shall not be relieved from paying such charges. No discount or refund will be provided for account suspension. To reactivate an account suspended for non-payment, the full amount owing on the account must be paid, and the payment will be applied retroactively to the beginning of the account's billing period. The billing period will not change.
    14. Accounts which are closed and subsequently re-opened may be assessed a setup fee, to be applied at Korax' discretion.
  6. Termination of service
    1. This agreement may be terminated by Korax by giving the Customer 30 days written notice. Notice may be given by E-mail. If Korax elects to terminate this agreement for reasons other than a violation of the terms (such as discontinuation of a service to which the Customer has subscribed), Korax shall return the remaining portion of any pre-paid amount to the Customer, and shall have no further liability to the Customer. Otherwise, the remaining portion of any pre-paid amount is not refundable per section 6.d. of these Terms.
    2. Korax may terminate service under this agreement at any time and without refund if the Customer fails to comply with the terms of this agreement, including, but not limited to, non-payment.
    3. The Customer may terminate this agreement by providing written notice of cancellation no later than 15 days prior to the end of the current billing period of the Customer's account. Notice may be given by E-mail. Upon receipt of written notice, Korax will close the Customer's account and terminate all services at the end of the account's current billing period. The Customer's account will remain active until the end of the current billing period. Partial refunds will not be provided, regardless of the date on which the Customer provided notice of cancellation.
    4. The Customer agrees that accounts may be closed only at the end of a billing period, and that closure of accounts at any other time shall be solely at Korax's discretion. Any remaining portion of any prepaid amount is not refundable. The Customer further agrees that a notice of cancellation shall not relieve the Customer from the terms of this agreement until the account has been closed by Korax and all amounts owing have been paid in full.
    5. The Customer agrees that lack of use of the Customer's account, regardless of reason, shall not relieve the Customer from the terms of this agreement.
    6. It is the Customer's sole responsibility to retrieve all personal files, data and E-mail from Korax's servers before requesting account termination or allowing the account to expire. Accounts which are allowed to expire will be automatically suspended. It will not be possible to retrieve files, data or E-mail from an account which has been suspended or terminated.
    7. Accounts may be removed at any time and without notice after being suspended for non-payment or any other reason. This includes all files, E-mail, and other contents belonging to the account.
  7. Agreement
    1. These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. These Terms and Conditions and the services they describe, and all fees for such services, may change at any time and without notice, and shall become binding notwithstanding any such change. Use of Korax services constitutes full acceptance and binding agreement to these Terms and Conditions.
